TERMS OF SERVICE

 

This policy is an agreement made by The Company (herein referred to as 'Valeria Silva', 'Our', and/or 'We'), including any of its directors, founders, executives, employees, staff, agents, or subcontractors, and The Client (herein referred to as 'You', 'Your', and/or 'Member') upon purchasing and signing up for The Femmepower Collective (also referred to as 'Membership' and/or 'The Femmepower Collective') outlined within this Website and/or on any Social Media Platform used by and in the name of The Company.

 

By signing up for,  purchasing and/or becoming a Member of The Femmepower Collective monthly Membership, you hereby agree to the following stated terms:

 

DISCLAIMER

  1. Non-Medical Professionals: You understand that Valeria Silva and its directors, founders, executives, employees, staff, and/or agents are not therapists, registered dieticians, lawyers, accountants, doctors, financial analysts, psychotherapists, psychologists, or business managers. Therefore, Your participation in The Femmepower Collective will not treat or diagnose any illness, disease, or ailment. If You experience any such issues, You should see your own registered practitioner or physician and determine, by Your own judgment, whether before starting or during The Femmepower Collective, to seek medical advice accordingly, including but not limited to the termination of any prescribed medication.
  2. Personal Responsibility: You understand that You are fully responsible for your mental health, dietary, mental, emotional, and physical choices throughout Your commitment to The Femmepower Collective and understand that The Femmepower Collective is not a substitute for healthcare, nutritional, or medical advice. You understand that You are fully responsible for any adverse reactions, whether emotional, mental, or physical, in relation to participation in The Femmepower Collective.
  3. Limitation of Liability: You agree that Valeria Silva is not responsible for any loss, including financial loss, damage, or bodily injury caused by the use of The Femmepower Collective. To the maximum extent possible under the applicable law, Valeria Silva will not be responsible for any direct, indirect, or consequential damages arising in any way from the use of The Femmepower Collective.

 

AGREEMENTS

  1. Emotional Self-Development: You understand that Your commitment to The Femmepower Collective may cause emotions to arise due to the self-development work being undertaken (including but not limited to Emotional Clearing, EFT, and NLP Coaching).
  2. Disclaimer for Coaching & Content Outcomes: You understand that results may vary for each individual and whilst We are committed to supporting our Members, We cannot guarantee specific outcomes of results.
  3. Alcohol and Drug Usage: You understand that drug and alcohol use may hinder Your progress (specifically in relation to any Emotional Clearing, EFT, or NLP Coaching practices taking place). You agree to take full responsibility for any use of such substances, including any side effects as a result of such use. You agree to disclose any prescription medication, recreational drug, or alcohol use to Valeria Silva, should you feel it is required, specifically when used within 36 hours of live sessions which include emotional clearing, EFT, and NLP Coaching practices.
  4. Recording of Live Group Sessions: You understand that live group sessions, including but not limited to, monthly Women's Circles and Masterclasses, will be held on Kajabi Live Video or Zoom and recorded and posted in the Kajabi Membership Portal, in order for members to watch on replay. You, therefore, agree to be recorded when attending live group sessions which include both visuals and conversations. You also agree for these recordings to be shared within the Kajabi Members Library of this Product and accessed by The Femmepower Collective's Members. You understand that at any point in which you do not wish to be recorded, you will be required to turn off your Camera and/or Microphone.
  5. Use of Recorded Content for Marketing Purposes: You understand that if at any point Valeria Silva, its directors, founders, executives, employees, staff, agents and/or subcontracted practitioners, therapists or coaches, wish to use any recorded content for marketing purposes across its website, social media channels, marketing materials, and other related platforms, We will be in contact with You directly to request permission prior to such use.
  6. Confidentiality: You understand that live group sessions, including but not limited to, monthly Women's Circles and Masterclasses, take place in a non-judgmental ‘safe space’ and that the content of the conversations and self-development work provided will be kept completely private and confidential within the group. You, therefore, agree NOT to share any of the conversations and/or self-development work undertaken with anyone outside of The Femmepower Collective.
  7. Intellectual Property Rights: You understand that any and all of the content provided within The Femmepower Collective is under the Intellectual Property Rights of Valeria Silva, and, therefore, agree NOT to copy, duplicate or mimic this content as your own. 
  8. Intellectual Property Usage: You agree to not use any of the materials, resources, or content provided by Valeria Silva within The Femmepower Collective for commercial purposes or otherwise without explicitly crediting Valeria Silva and/or any of it’s directors, founders, executives, employees, staff, agents and/or subcontracted practitioners, therapists or coaches within The Femmepower Collective.
  9. Personal Commitment: You take full responsibility for Your experience throughout The Femmepower Collective and the results You gain. You understand that significant change in Your life as a result of the self-development, mental, emotional, and physical work will depend on how much commitment You make to Yourself and The Femmepower Collective.
  10. Effective Communication: You agree to communicate honestly, diplomatically, and openly with Valeria Silva, and any of The Femmepower Collective’s directors, founders, executives, employees, staff, agents and/or subcontracted practitioners, therapists or coaches, should You feel any part of this agreement has not been honored. You also agree to attempt to resolve any issue immediately and with full integrity should one arise, by emailing Valeria Silva at [email protected].
  11. Monthly Subscription Fee: You understand that by signing up for The Femmepower Collective, You agree to pay the monthly recurring subscription fee, which is noted on the checkout page, and you will be required to provide your payment details. You understand that this monthly subscription fee will be deducted from Your specified bank account on the date of your initial subscription, and each month thereafter until Your subscription is canceled or terminated.
  12. Termination of Subscription: You agree to provide one month's notice to Valeria Silva should you wish to terminate your subscription to The Femmepower Collective by emailing Valeria at [email protected]. You agree and understand that Valeria Silva reserves the right to terminate a member's subscription to The Femmepower Collective in the following circumstances:
  • Violations of Terms: Members found to be in violation of any of the stated Terms of Service may face termination of their membership without a refund.
  • Disruptive or Unethical Behaviour: Members who engage in disruptive, abusive, harmful, or unethical behaviour within The Femmepower Collective community or during coaching sessions may have their subscription revoked.
  • Non-Payment: If a member's payment fails on the first attempt, an email notification will be sent, and a second attempt to process the payment will be made a few days later. Should the second attempt fail, the member's subscription will be automatically revoked, and access to The Femmepower Collective will be suspended.
  1. Modification of Terms: Valeria Silva reserves the right to modify the Terms of Service with prior notice to the members. Any updates or changes to the Terms of Service will be communicated through the email address provided by the member unless otherwise stated or informed. It is the member's responsibility to regularly review the Terms of Service for any updates or modifications. Continued use of The Femmepower Collective after the modifications have been made will constitute acceptance of the updated Terms of Service.
  2. Refund Policy: You understand that Valeria Silva has a no-refund policy and that any refunds or credits are given at her own discretion and under no legal obligation. Please click HERE for the Refunds Policy applicable to The Femmepower Collective.
  3. Permission to Coach: You give Valeria Silva and any of The Femmepower Collective’s employees, staff, agents and/or subcontracted practitioners, therapists or coaches full permission to be honest and direct with You, to hold You accountable to Your word, and to take You out of Your comfort zone when required in order to help You get the results You seek.
  4. Trust in Expertise: You understand that You have chosen to work with Valeria Silva and any of The Femmepower Collective’s employees, staff, agents and/or subcontracted practitioners, therapists or coaches, based on Your own trust in their ability and expertise. You acknowledge that the healing, emotional clearing, and self-development processes undertaken will be explained to You, so You understand how any of the processes work. You agree to take full responsibility for asking for further clarification if it at any point You do not understand how the processes work.
  5. Age Restriction: You understand that The Femmepower Collective is open to any woman aged 18 and above. By signing up for The Femmepower Collective, you confirm that you are at least 18 years old.
  6. Success Stories and Testimonials: Valeria Silva may request members of The Femmepower Collective to share their success stories or testimonials related to their experience with The Femmepower Collective and any of its related Programmes. By submitting a success story or testimonial, You agree to grant Valeria Silva the right to use, reproduce, and publish their feedback for promotional purposes on The Femmepower Collective's website, social media channels, marketing materials, and other related platforms. Members further acknowledge that their success story or testimonial may be edited for clarity and length, but Valeria Silva will not alter the overall sentiment of the feedback provided. You understand that any success stories or testimonials shared will be done with consideration for the anonymity of the Member, which can be stated/declared upon the submission of such success story or testimonial by the Member.
  7. Severability Clause: If any part of this agreement is found to be invalid, unenforceable, or illegal under the laws of Guernsey, Channel Islands, You understand that the validity and enforceability of the remaining provisions of the Terms of Service shall not be affected. The parties shall make reasonable efforts to replace the invalid or unenforceable provision with a valid and enforceable one that accomplishes the original purpose of the agreement.
  8. Waiver of Breach: The failure of Valeria Silva to exercise or enforce any right or remedy under this agreement shall not constitute a waiver of any future breach or default of the same or other provisions. No waiver shall be effective unless it is explicitly stated in writing and signed by an authorized representative of Valeria Silva.
  9. Indemnification Clause: By using The Femmepower Collective, You agree to indemnify and hold Valeria Silva, its directors, founders, executives, employees, staff, agents and/or subcontracted practitioners, therapists or coaches harmless from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from their use of the Membership, their conduct within The Femmepower Collective community, or any violation of the Terms of Service or applicable laws.
  10. Force Majeure: Valeria Silva shall not be liable for any failure or delay in the performance of any obligations under the Terms of Service due to events beyond its reasonable control, including but not limited to acts of God, pandemic, epidemic, war, terrorism, strikes, labor disputes, natural disasters, government orders or regulations, or any other force majeure event. In the event of a force majeure event, Valeria Silva will make reasonable efforts to resume its obligations as soon as practicable.
  11. Dispute Resolution: In the event of any dispute or disagreement arising out of or relating to the Terms of Service or the use of The Femmepower Collective, that is not resolved, both parties agree to resolve the matter through alternative dispute resolution methods, such as arbitration or mediation. The location, rules, and procedures for such alternative dispute resolution shall be determined by mutual agreement between the parties. The decision reached through arbitration or mediation shall be final and binding on both parties.

Your privacy is important to Us. Our Use of Personal Information is outlined in Our Privacy Policy, which you can find HERE. By signing up for The Femmepower Collective, You acknowledge and agree to the terms of our Privacy Policy.

 

GOVERNING LAW & JURISDICTION

These Terms of Service shall be governed by and construed in accordance with the laws of Guernsey, Channel Islands. Any dispute arising under or in connection with these Terms of Service shall be subject to the exclusive jurisdiction of the courts of Guernsey, Channel Islands.
